Eligibility - NAIT Volleyball - Timanson

Facts:

I have been advised by NAIT that they just recently discovered that Men’s Volleyball player, Spencer Timanson, was not eligible to compete during the 8 matches he has competed in so far this season. NAIT had neglected to complete a Universal Transfer Form for Mr. Timanson, who attended GPRC during the 2011-12 school year and failed all of his courses during the first semester, and withdrew for the second semester. According to NAIT, its coach was under the mistaken impression that Mr. Timanson had last competed during the 2010-11 season.

Ruling:

Mr. Timanson has now been removed from the NAIT team. Of the 8 matches in which he competed, NAIT won only once, against CUCA on October 25, 2012, which is fortunate as this violation could have potentially wreaked havoc on the ACAC standings.

Article I Section 5 Rule 10 of the ACAC Operating Code reads as follows:

10.1. Use of an Ineligible Student-Athlete 
Where it has been determined that a member institution is in violation of the rules of eligibility and has used an ineligible student-athlete, other than as identified in Article 10.2, the Commissioner shall exercise his or her discretion to determine an appropriate sanction. (Amended October, 2011)

It is clear that NAIT is in violation of Rule 10.1. The sanction for this violation is as follows:

  1. NAIT shall forfeit its victory over CUCA on October 25, 2012 and the match shall be recorded as a victory for CUCA; and  
  2. NAIT shall pay a fine to the ACAC Office in the amount of $1,000.
