2010-11 SeasonFACTS: On December 3, 2010 Augustana’s Jeremy Beirnes (#96) received his 4th game misconduct of the season. He then played the next day and received his 5th game misconduct on December 4, 2010. RULING: Article I Section 13 Rule 9.4.1.2 calls for an automatic one (1) game suspension upon receipt of a 4th game misconduct in a season. Further, Rule 9.4.1.3 calls for a further one (1) game suspension upon receiving a 5th game misconduct. Upon receiving his 4th game misconduct, Mr. Beirnes should have sat out on December 4th. He did not. Augustana lost that game 4-1 to NAIT. Had Augustana defeated NAIT on December 4th, the result would have been forfeited. Instead, Mr. Beirnes shall serve his one (1) game suspension for receiving a 4th game misconduct during Augustana’s next scheduled league game. Mr. Beirnes is also suspended for one (1) further game for receiving his 5th game misconduct on December 4th. The suspension shall be served as follows:
In addition to the above, Augustana shall immediately pay a fine of $250.00 to the ACAC office. Please note that a 6th game misconduct will result in automatic league review. Sincerely, Bill Hendsbee Blaine and Greg, It is my usual practice to send warnings. I do not send them to coaches as all official contact is through Athletic Directors. I do not appear to have kept a record of having done so in this case. However, it is also the responsibility of coaches to keep track of game misconduct In this case, since it is not clear that a warning was sent, I will rescind the fine (and I have copied this message to Bob Day so that he can reflect this change to my original ruling within the ACAC Office). If I failed to provide notice, please accept my apologies. However, Mr. Beirnes still has to sit the two games required for receiving his 4th and 5th game misconducts so that portion of the ruling stands. Regards, |
