Description of Circumstances:
References are to Operating Code Article III Section 16 – DELAY/POSTPONEMENT/CANCELLATION
- A large-scale power disruption in the sector of Ft. McMurray where Keyano College is located impacted the Syncrude Sport and Wellness Centre on the afternoon of Saturday Jan. 13/18.
- This power disruption delayed preparations for the second day of the ACAC UAA @ KC doubleheader Volleyball series (1.1.7). Both teams were required to wait in the unheated building anticipating that the power interruption was temporary and power would imminently be restored.
- After some time, Athletic Directors Jonathan Lambert and Greg Ryan deliberated on the best course of action (1.2). A call was placed to the CEO and it was advised to reference Article III, Section 16. Furthermore, given the distance between the institutions, it was emphasized that the host athletic director and the coaches should make every effort to ensure that the competition is played. (1.2.1)
- An alternative facility was eventually secured by KC with the expectation that both matches could be played. Because of the time delay, this likely would have required UAA to remain in Ft. McMurray for the Saturday night with responsibility for that additional cost to be determined, although late travel back to Camrose was not entirely ruled out.
- UAA would only agree to play the MVB match citing several reasons including a concern for the health and safety of student-athletes. The decision was ultimately made to postpone the matches and attempt to reschedule for another date. (2.0)
- Subsequent discussions and email exchanges involving the two Athletic Directors along with the CEO, to determine a date, location, other conditions and cost-sharing arrangement for the rescheduled matches did not achieve mutual agreement.
- It was mutually agreed that the matter would be referred to arbitration by the ACAC Executive Committee, meeting on Wednesday February 7/18. (2.7)
- Both UAA and KC were invited to make written submissions to the ACAC Executive, describing the circumstances and proposing a resolution to all matters related to rescheduling the matches. KC proposed rescheduling for Feb. 11/18 @ KC but UAA did not suggest an alternative date nor location.
Decision:
The ACAC Executive has ruled the following:
- The matches shall be rescheduled to be played on Sunday February 11/18
- Women’s match @ 3pm; Men’s match @ 5pm (to follow)
- The matches will be played at the Syncrude Sport and Wellness Centre in Ft. McMurray
- KC will be responsible for all hosting costs and to communicate with the VOA Officials Assignor to secure officials for the matches.
- KC will be responsible for either the accommodation expenses for the entire UAA contingent or alternatively, the cost for an additional bus driver should UAA choose to return to Camrose following the matches.
- UAA will be responsible for all other travel related expenses.
Follow-Up Action Required of UAA and KC by email to the ACAC office before 4pm February 8, 2018:
- Confirm acknowledgement and voluntary compliance with this arbitration decision, OR;
- Communicate intent to Appeal this decision as per OC Article III, Section 4, OR;
- Indicate acceptance of a forfeiture which may result in penalties as per OC Article I, Section 12, 9.0
If written communication is not received by the deadline clearly indicating selection of one of the three options listed above, it shall be interpreted as acceptance of the arbitration decision and that the matches will be played as rescheduled.
