Facts: Jacob Cusumano sustained a season ending knee injury during the 2009-10 season while playing for Valley City State University in the NAIA. He had participated in three (3) of his school’s thirty (30) game schedule. Mr. Cusumano now seeks a ruling that he has not used one (1) year of eligibility in relation to his participation during the 2009-10 season. Ruling: Article I Section 5 Rule 1.4.5 of the ACAC Operating Code states as follows: A student-athlete who suffers a season-ending injury limiting his/her participation to no more than 30 percent of his/her league schedule, as documented by letter from the attending physician, physiotherapist, or chiropractor, and by letter from the Athletic Director(s) of the institution(s) concerned, shall be regarded as not having played in that year. I have been provided with a letter of request from RDC, along with a note from Mr. Cusumano’s physician, confirming that he sustained season ending injuries. If this injury had taken place while Mr. Cusumano was a member of an ACAC team, I would not hesitate to rule in his favour. However, given that the injury took place while Mr. Cusumano was a member of an NAIA team, any eligibility ruling in relation to the 2009-10 season must be made by the NAIA. Should the NAIA rule that Mr. Cusumano did not use eligibility during the season in question, the ACAC will honor that ruling. Sincerely, Bill Hendsbee
Post-scriptNAIA granted Official Harship to Mr. Cusumano for the 2009-10 season on June 13, 2014, Case # 14-NSAA-11M. Mr. Cusumano's will have his year of eligibility returned for 2009-10.
