2010-11 SeasonSeptember 7, 2010 Facts: Kim Day plays for the RDC Women’s Hockey team. She is a student in the school’s nursing program. Due to logistical issues at RDC, Ms. Day is unable to commence the current year of her program until October 26, 2010. Although she intends to take an elective course in the interim, she will not be a full time student until October 26, 2010. Ms. Day seeks a ruling allowing her to compete in four (4) games prior to October 26, 2010. Ruling: Article I Section 5 Rule 1.1.1 of the ACAC Operating Code states as follows: The ACAC defines full time status as being registered in and attending a minimum of three (3) credit courses totaling nine (9) credit hours (or equivalent as determined by the institution’s Registrar), in each semester in which they participate in ACAC competition. Clearly, prior to October 26, 2010, Ms. Day does not satisfy Rule 1.1.1. Rule 1.1.1.2 states as follows: In the case of apprenticeship students who are enrolled and attending full time classes, they will be eligible to compete during their time in class as well as to the end of that semester. Apprenticeship students are not eligible to compete until they are attending full time classes. There is no rule that allows for an exception to the full time status requirement in Rule 1.1.1. The closest analogy to the current situation is the case of an apprenticeship student, who would not be eligible to compete until she was attending full time classes. Though this logistical issue is not due to any fault on Ms. Day’s part, allowing her to compete in circumstances where an apprenticeship student would not be allowed to compete, would not be fair.
